This paper will describe the methodology for teaching legal English used at the Fordham University School of Law’s Legal English Institute, a one-semester program for law students and attorneys. Reasonable minds may disagree about the most effective methodology for teaching legal English, or for that matter any other form of academic English, but we have developed an approach that is informed by both theory and practice. At LEI, we use a “modified CLIL” format, with four substantive classes on topics in (...) U.S. law that run in parallel with a core class on legal English. All four substantive classes use authentic reading materials that are similar to those used in an LL.M. program, and these materials are recycled in the legal English class and form the basis of discussions about language issues. Our use of content classes to elicit language issues has proven to be effective and it also helps keep students motivated, as students tend to have more intrinsic interest in legal topics than in language study per se. The COVID‐19 pandemic exposes underlying inequalities in our socio‐economic and health systems, such as gender‐based violence (GBV). In emergencies, particularly ones that involve quarantine, GBV often increases. Policymakers must utilize community expertise, technology and existing global guidelines to disrupt these trends in the early stages of the COVID‐19 epidemic. Gender norms and roles relegating women to the realm of care work puts them on the frontlines in an epidemic, while often excluding them from developing the response. When The Age renamed the corner of Russell and Bourke streets the ‘Golden Elbow’ it brought the city into close proximity with an altogether different city. Neither Chang Mai, Hong Kong nor Melbourne, the Golden Elbow was defined by what it could be. Neither one thing nor another, the Golden Elbow is a space of the city-becoming-other. Through narrative work and news media maps of no-go zones, machines mobilise fear and thus value, from the desire flowing through this abject zone. (...) Capitalism sucks value from these encounters through the production of fear as affect. The city-becoming-other is both enormously productive, and destructive of bodies caught up in the mix. This article explores the flow of desire and the abject of a city becoming other through a street drug marketplace. The encounter with the abject brings use closer to the beauty and fear of ontological mixity. (shrink)

From the pre-Socratics to the present, one primary aim of philosophy has been to learn from arguments. Philosophers have debated whether we could indeed do this, but they have by and large agreed on how we would use arguments if learning from argument was at all possible. They have agreed that we could learn from arguments either by starting with true premises and validly deducing further statements which must also be true and therefore constitute new knowledge, or that we could (...) start from putative premises and validly deduce false consequences thereby showing that our premises were false. Our aim in this paper is to suggest a third alternative: we can learn from plausible arguments through criticism of such arguments which enable us to discover new problems. (shrink)

For the last 20 years or so, philosophers of mind have been using the term ‘qualia’, which is frequently glossed as standing for the “what-it-is-like” of experience. The examples of what-it-is-like that are typically given are feelings of pain or itches, and color and sound sensations. This suggests an identification of the experiential what-it-islike with such states. More recently, philosophers have begun speaking of the “phenomenology“ of experience, which they have also glossed as “what-it-is-like”. Many say, for example, that any (...) acceptable materialism—or any acceptable account of the relation of mind and body—must “respect the phenomenology.”1 Typically, no examples beyond those mentioned in the first paragraph are offered. This suggests that the picture of the phenomenology that ”must be respected” is the what-it-is-like of bodily sensations, of sensations that occur in perception, and perhaps of certain analogous nonperceptual states, such as imaginings and image-like rememberings. According to the suggested picture, all there is to phenomenology is such states; intentional mental states—as such— have no phenomenology; there is nothing that it is like to undergo them. Although beliefs and desires are intentionally directed—i.e., they have aboutness—these mental states allegedly are not inherently phenomenal. On this view, there is nothing that it is like to be.. Since public schooling was introduced in the nineteenth century, teachers in many western countries have endeavoured to achieve professional recognition. For a short period in the latter part of the twentieth century, professionalism was seen as a discourse of resistance or the ‘enemy’ of economic rationalism and performativity. However, more recently, governments have responded by ‘colonizing’ professionalism and imposing ‘standards’ whereby the concept is redefined. In this study, we analyse transcripts of interviews with 20 Queensland teachers and conclude that teachers’ (...) notions of professionalism in this second decade of the twenty-first century are effectively reiterations of nineteenth century disciplinary technologies (as proposed by Michel Foucault) yet are enacted in new ways. Charvet’s arguments revolve around very recent discussions in Anglo-American analytical ethics and political philosophy. He considers and rejects, for example, arguments in favor of both Thomas Nagel’s version of ethical realism and the view that value is constituted by fulfillment of our strongest desires. Both suffer from the inadequate “shared assumption as to the fundamental independence of desire and value, and hence desire and reason”. Instead, we should see both as “interdependent”; value “comes into the world through the medium of (...) the interacting desire and the belief systems of the organism as these articulate and project onto the environment the organism’s needs”. He likewise rejects Nagel’s and Parfit’s views on prudential rationality and personal identity, arguing that no “attempt to establish [personal identity] purely in impersonal terms” can succeed, that “the self is a basic primitive concept that is presupposed in all experience”. It is a mixed pleasure to see F. Matthias Alexander acknowledged in the fall 2007 issue of Education and Culture ("Dewey, women, and weirdoes: Or, the potential rewards for scholars who dialog across difference," 23[2], 27-62). As a professional descendant of Alexander who has been teaching the Alexander Technique (AT) for 30 years, I am glad to see Cunningham et al. including him in the list of positive influences in John Dewey's life. However, I believe Cunningham's contribution to this (...) article, "Shared explorations of body-mind: The reciprocal influences of Dewey and F. M. Southerwood, Terry On 7 May 1820, four days after landing at Sydney, Australia's first Vicar General, Fr Philip Conolly, celebrated Mass for the first time on the soil of this continent. He was assisted by the co-pioneer, Fr John Joseph Therry. This historic liturgical action took place at the house of John Reddington in Pitt Row, later the site of many a dramatic event, Her Majesty's Theatre. At this time both priests were guests of the Davis household (...) in Charlotte Square. The following day, also at Reddington's, Therry offered Mass for the glory of God and in honour of St Michael. Examines the religious philosophy of John Hick, with an emphasis on his attempt to show that theistic claims are factually significant.

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

This article provides Catholic authorities with a useful framework for forming prudent and just policies to minimize clerical child sexual abuse, exploiting the 2011 John Jay College report Causes and Context while not ignoring its shortcomings. The framework is St. Thomas Aquinas’s treatment of prudence, and a “profile” of the clerical perpetrators is developed that uses their narcissism as a middle term to explain why these men behaved the way they did. The author concludes by recommending a deterrent policy (...) similar to the policy advocated by St. Paul, which does not unrealistically aim at an angelic clergy but aims to deter those who would enter the priesthood for its benefits. Bayesians take “definite” or “single-case” probabilities to be basic. Definite probabilities attach to closed formulas or propositions. We write them here using small caps: PROB(P) and PROB(P/Q). Most objective probability theories begin instead with “indefinite” or “general” probabilities (sometimes called “statistical probabilities”). Indefinite probabilities attach to open formulas or propositions. We write indefinite probabilities using lower case “prob” and free variables: prob(Bx/Ax). The indefinite probability of an A being a B is not about any particular A, but rather about the (...) property of being an A. In this respect, its logical form is the same as that of relative frequencies. For instance, we might talk about the probability of a human baby being female. That probability is about human babies in general — not about individuals. If we examine a baby and determine conclusively that she is female, then the definite probability of her being female is 1, but that does not alter the indefinite probability of human babies in general being female. Most objective approaches to probability tie probabilities to relative frequencies in some way, and the resulting probabilities have the same logical form as the relative frequencies. That is, they are indefinite probabilities. The simplest theories identify indefinite probabilities with relative frequencies.3 It is often objected that such “finite frequency theories” are inadequate because our probability judgments often diverge from relative frequencies. For example, we can talk about a coin being fair (and so the indefinite probability of a flip landing heads is 0.5) even when it is flipped only once and then destroyed (in which case the relative frequency is either 1 or 0). For understanding such indefinite probabilities, it has been suggested that we need a notion of probability that talks about possible instances of properties as well as actual instances.. (shrink)

Although by no means sharing the depth and magnitude of the investigations by Leibniz being undertaken at the same time, and although in particular not yet applying algebraic symbolism to logical structures, the treatise is of historical interest as an early published attempt to trace out analogies between logical and mathematical form, and may be viewed as a preliminary step toward (...) the formalization of logic. Autonomy operates as a key term in debates about the rights of families to choose distinct approaches to education. Yet, what autonomy means is often complicated by the actual circumstances and contexts of schools, families, and children. In this essay, Terri S. Wilson and Matthew A. Ryg focus on the challenges involved in translating an ideal of educational autonomy into the “nonideal” contexts and circumstances that surround families' choices. Drawing on the methodological insights of Elizabeth Anderson and John Dewey, (...) they sketch out a nonideal approach for exploring autonomy. Wilson and Ryg particularly focus on Dewey's notion of an ideal, his treatment of autonomy as a concept, and his view of the self. Such a nonideal approach draws attention toward the specific circumstances, habits, and environments that make autonomy possible. School choice positions parents as consumers who select schools that maximize their preferences. This account has been shaped by rational choice theory. In this essay, Terri Wilson contrasts a rational choice framework of preferences with John Dewey's understanding of interest. To illustrate this contrast, she draws on an example of one parent's school decision-making process. Dewey's concept of interest offers an alternative conceptual vocabulary attentive to the complex, value-laden, and evolving process of choosing a school. It then discusses several questions left unresolved by these books – concerning the problem of democratic legitimacy, the normativity of democratic standards and the power dynamics undergirding democratic agency – which jointly mark out an important agenda for future theoretical work on pathways out of democratic crisis. This paper is about the development of logic in the Aristotelian tradition, from Aristotle to the mid-fourteenth century. I will compare four systems of logic with regard to their expressive power. 1. Aristotle’s own logic, based mostly on chapters 1-2 and 4-7 of his Prior Analytics 2. An expanded version of Aristotle’s logic that one finds, e.g., in Sherwood’s Introduction to Logic and Peter of Spain’s Tractatus 3-5. Versions of the logic of later supposition theorists such as William Ockham, (...) class='Hi'>John Buridan, and Paul of Venice. Version 4 is the logic without relatives ; version 5 adds relatives. I am ignoring modals, conditionals that are not ut nunc, infinitizing negation, exclusives and exceptives, all exponibles, all insolubles, and terms with simple or material supposition, ampliation and restriction, and many other things.
